On the Optional Function and Restrictions of the Substantive
Factors in the Judges' Process-Based Thinking

Abstract: The process-based thinking is the main type of legal thinking in judicial process, but the substantive factors are unavoidable in the legal thinking. The optional function could be a bridge of communication between process and substantive. In the beginning, running, and feedback of the judicial process, the optional function of substantive factors shows different appearances and is limited by different restrictions. Some of these restrictions are parts of the legal thinking, some are the legal institutions without legal thinking, and some are between the two. For the substantive factors to be positive and effective in the process-based thinking, the factors should be guided by many kinds of means properly.
